Parties: 1) Henry Champernowne esq. of Memland [Membland], Devon (brother and heir of the late Arthur Champernowne esq. also of Memland)
2) Sarah Champernowne of Yealmpton, Devon, widow
3) Henry Legassicke of Modbury
Property: Capital messuage Barton Farm and demesne lands of Membland, with appurtenances etc.
Recital: By an indenture of 19th March 1699/1700 between the late Arthur Champernowne (1) and Sarah Champernowne (2), for the consideration of £150 paid by (2) to (1), (1) leased to (2) the specified property, late in the possession of Richard Hillersdon and afterwards in the possession of (1), for the term of 1000 years. With the proviso that on payment of the sum of £153 15s to (2) the indenture would be void. On the death of Arthur Champernowne the debt had not been paid, and so the property passed to Sarah Champernowne by law.
Transaction: By this indenture, Sarah Champernowne acknowledges receipt of the capital sum of £150 from Henry Legassicke and grants to him the property specified for the remainder of the original term of 1000 years.
Consideration: £250 paid by Henry Legassicke (3) to Henry Champernowne (1). (3) also pays to (1) one grain of wheat on the 25th of March yearly during the term of the lease if demanded. Henry Champernowne is to repay the sum of £420 to Henry Legassicke, which will include the original mortgage.
Term: 996 years (remainder of 1000 year original lease)
Witnesses: Margret Champernowne (signs 3 times, variant spelling Margreat Champernaune), Charles Legassicke, Richard Horning, Sarah Champernowne, Henry Champernowne.
